User Obligations

Health and Safety

• You participate in all activities at your own risk

Membership and Payment Terms

Membership and payment terms include:

• Membership fees are due in advance and are non-refundable unless otherwise specified
• Prices are subject to change with 30 days' notice
• Automatic renewal terms apply unless cancelled according to our cancellation policy
• Late payment may result in suspension of services
• All payments must be made in Euros (EUR)

Intellectual Property

All content, materials, and intellectual property on our website and in our services, including but not limited to text, graphics, logos, images, software, and training programmes, are the exclusive property of PolarMomentum or our licensors and are protected by copyright, trademark, and other intellectual property laws.

You may not reproduce, distribute, modify, create derivative works from, publicly display, publicly perform, republish, download, store, or transmit any of our content without our prior written consent, except as permitted by applicable law or as expressly provided in these Terms.

Privacy and Data Protection

Limitation of Liability

Our total liability for any claims arising from or relating to these Terms or our services shall not exceed the amount paid by you to PolarMomentum in the twelve (12) months preceding the claim.

Some jurisdictions do not allow the exclusion or limitation of certain damages, so some of the above limitations may not apply to you.

Indemnification

You agree to defend, indemnify, and hold harmless PolarMomentum and its directors, employees, agents, and affiliates from and against any and all claims, damages, obligations, losses, liabilities, costs, and expenses (including reasonable legal fees) arising from your use of our services, your violation of these Terms, or your infringement of any third-party rights.

Termination

We reserve the right to terminate or suspend your access to our services immediately, without prior notice or liability, for any reason, including but not limited to breach of these Terms, non-payment of fees, or violation of our facility rules.

You may terminate your membership or use of our services at any time by providing written notice in accordance with your membership agreement or our cancellation policy.

Upon termination, your right to use our services will cease immediately, and you must return any materials or equipment provided by PolarMomentum.

Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Netherlands, without regard to its conflict of law principles. Any legal action or proceeding arising under these Terms will be brought exclusively in the competent courts of the Netherlands, and you hereby consent to the personal jurisdiction and venue therein.

If you are a consumer resident in the European Union, you may also bring proceedings in the courts of your country of residence, and nothing in these Terms affects your rights as a consumer under applicable EU consumer protection laws.

Dispute Resolution

Before initiating any legal proceedings, we encourage you to contact us directly to resolve any disputes. We are committed to working with you to find a mutually acceptable solution.

Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of any material changes by posting the updated Terms on our website and updating the "Last updated" date. Your continued use of our services after such modifications constitutes your acceptance of the updated Terms.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect. The invalid or unenforceable provision will be replaced with a valid and enforceable provision that most closely approximates the intent of the original provision.

Entire Agreement

These Terms, together with our Privacy Policy and any additional agreements you may have with PolarMomentum, constitute the entire agreement between you and PolarMomentum regarding the use of our services and supersede all prior and contemporaneous agreements, representations, and understandings.
